Leases

Some might suggest Leases are obsolete given the role of RTB.ie (insert link). Legislation surrounding tenancies is monitored by the Residential Tenancy Board and clear obligations and requirements under Law are available on their site. However it’s very important to have a formal lease in place so both tenant and landlord expectations are managed and  observed.

The Lease will deal with expectations in respect of maintenance, protocol and procedures, where responsibility lies in respect of garden ie., grass cutting.

The lease will also outline the term, start date and length of contract. A six month contract is recommended by Whitford Properties as it gives both parties an opportunity to ensure it’s the right fit.

A formal Lease should be provided by your Agent and all aspects of the tenancy should be detailed. The more information entailed at inception the easier to resolve issues.

Ask yourself the basics, are pets allowed, who’s cutting the grass, how often should the boiler be serviced? Include information on inspections and frequency of same. Utilities should be placed in tenant name and the Landlord should be aware of the Utility Company name and have access to the account .

The lease will also cover certain aspects of legislation but be mindfully that legislation changes frequently, particularly in this climate of uncertainty and pandemic.
